OVERVIEW

Pension central is a product of Chams Access Limited.

Pension Central helps employers to electronically submit pension schedules and make all pension payments conveniently from the comfort of their offices with few clicks & zero stress. Please read these Terms of Use carefully before using the pensioncentral.ng Platform ("Platform"). Users who are under 18 years of age should review these terms and conditions with a parent or guardian. Your access to and use of the Platform by way of any Device is conditioned on your acceptance of and compliance with the provisions of this Terms of Use. By your accessing or using the Platform you agree to be bound by these Terms of Use as amended at any time and posted on the website www. Pensioncentral.ng. If you disagree with any part hereof, do not access the Platform. This document is a legally binding agreement between you as the user(s) of the Sites (referred to as "you", "your" "employer" or "User" hereinafter) and the pensioncentral.ng entity listed in clause below (referred to as "we", "our" or "www.pensioncentral.ng" hereinafter).

ChamsAccess provides the pensioncentral.ng Services subject to the following conditions:

TERMS AND CONDITIONS OF USE

USE OF THE SITE

You confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian. Both parties agree that this website may only be used in accordance with these Terms and Conditions of Use. If you do not agree with the Terms and Conditions of Use or do not wish to be bound by them, you agree to refrain from using this website.

We grant you a non-transferable, revocable and non-exclusive license to use this Site, in accordance with the Terms and Conditions of Use, for such things as: Submission of Pension Schedules and payment of pension. Commercial use or use on behalf of any third party is prohibited, except as explicitly permitted by us in advance.

The schedule transmitted through Pensioncentral.ng shall follow the existing industry flow. This simply means that upon successful payment confirmation, all electronically submitted schedules shall flow through Pension Fund Custodians (PFC) to Pension fund Administrators (PFA).

These Terms and Conditions of Use specifically prohibit actions such as: accessing our servers or internal computer systems, interfering in any way with the functionality of this website, gathering or altering any underlying software code, infringing any intellectual property rights. This list is non-exhaustive and similar actions are also strictly prohibited.

You shall not and shall not permit any person using your Device or account to:
  1. use this Platform in a way that causes or could cause damage or restrict the availability or accessibility of the Platform;
  2. store, copy, transmit, publish or distribute any computer virus, spyware, Trojan horse, worm, keystroke logger or other malicious software via this Platform;
  3. conduct any fraudulent or illegal activities via the Platform;
  4. You hereby understand and agree that if a fraudulent activity is associated with the operation of your account, We have the right to apply restrictions to your account and report to the appropriate law enforcement agencies

Any breach of these Terms and Conditions of Use shall result in the immediate revocation of the license granted in this paragraph without prior notice to you. Should we determine at our sole discretion that you are in breach of any of these conditions, we reserve the right to deny you access to this website and its contents and do so without prejudice to any available remedies at law or otherwise.

Certain services and related features that may be made available on the Site may require registration or subscription. Should you choose to register or subscribe for any such services or related features, you agree to provide accurate and current information about yourself, and to promptly update such information if there are any changes. The account owner is entirely responsible for all activities that occur under such password or account.

Pensioncentral.ng may amend any Terms at any time by posting the relevant amended and restated Terms on the Sites. By continuing to use the Services or the Sites, you agree that the amended Terms will apply to you.

YOUR ACCOUNT AND REGISTRATION OBLIGATIONS

If you use the Website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and you shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide You with access to the Website.

COMMUNICATIONS

When You use the Website or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

Our aim is to ensure accessibility to the website at all times, however we make no representation of that nature and reserves the right to terminate the website at any time and without notice. You accept that service interruption may occur in order to allow for website improvements, scheduled maintenance or may also be due to outside factors beyond our control.

FAILED TRANSACTIONS AND REVERSALS

In the event of a failed transaction (i.e. user has been debited for transaction, but value was not received), please send the following details to hello@pensioncentral.ng or Phone: +234 ( 01) 2944988 for resolution: user’s mobile number, transaction amount, transaction date, transaction type and any other detail we would request to enable us resolve your complaint.

LINKS AND THIRD PARTY WEBSITES

We may include links to third party websites at any time. However, the existence of a link to another website should not be considered as an affiliation or a partnership with a third party or viewed as an endorsement of a particular website unless explicitly stated otherwise. In the event the user follows a link to another website, he or she does so at his or her own risk. We accept no responsibility for any content, including, but not limited to, information, products and services, available on third party websites. Creating a link to this website is strictly forbidden without our prior written consent. Furthermore, we reserve the right to revoke our consent without notice or justification.

NOTICES

SECURITY AND UNAUTHORISED USE

You are responsible for all transactions conducted using your computer (personal or otherwise), mobile phone, tablet or other electronic device ("Device"), payment card or account. It is your responsibility to keep all of these secure All passwords must be kept secret. You are liable for all activities undertaken using your username, associated password or Device. You are responsible for maintaining the confidentiality of all Account information and keeping your Device from unauthorized use. We accept no liability for any unauthorized use of your Device, payment card or account or any effects of same. In the event your Device has been stolen or there is an unauthorized access to your payment card or account, it is your responsibility to immediately notify your bank to restrict transactions on your card and account. In the event your Device has been stolen or there is an unauthorized access to your pensioncentral.ng account, it is your responsibility to immediately to notify us through hello@pensioncentral.ng

SUSPENSION, TERMINATION OF ACCESS TO PLATFORM

We hereby reserve the right to suspend, restrict, or terminate your access to the Platform (in whole or in part) without any notice or liability in the following circumstances:

  1. Upon receipt of instructions from you to suspend or terminate your access to the Platform
  2. Upon receipt of notification from you that your Device has been lost or stolen
  3. If we suspect the Platform is being used for fraudulent or other illegal activities.
  4. If we are of the opinion that you have breached a provision contained in this Terms of Use.
  5. If we are of the opinion that continued access to the Platform will be detrimental to our business.
  6. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete.

INTELLECTUAL PROPERTY

Both parties agree that all intellectual property rights and database rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain at all times vested in us or our licensors. Use of such material will only be permitted as expressly authorized by us or our licensors. Any unauthorised use of the material and content of this website is strictly prohibited and you agree not to, or facilitate any third party to, copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. Nothing set forth in this Terms of Use shall constitute a transfer, license or assignment by us to you of any Intellectual Property Rights owned by us or displayed on the Platform

DATA PROTECTION

Any personal information collected in relation to the use of this website will be held and used in accordance with our Privacy Policy, which is available on our Site.

INDEMNITY

You agree to indemnify and hold us, our affiliates, officers, directors, agents and/or employees, as the case may be, free from any claim or demand, including reasonable legal fees, related to your breach of these Terms of Use and User Agreement.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions of Use shall be interpreted and governed by the laws in force in the Federal Republic of Nigeria. Subject to the Arbitration section below, each party hereby agrees to submit to the jurisdiction of the courts of Nigeria and to waive any objections based upon venue.

ARBITRATION

Any controversy, claim or dispute arising out of or relating to these Terms and Conditions of Use will be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in Nigeria in English and governed by Nigeria law pursuant to the Arbitration and Conciliation Act Cap A18 Laws of the Federation of Nigeria 2004, as amended, replaced or re-enacted from time to time. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Nigeria and is independent of either party. Notwithstanding the foregoing, the Site reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

LIMITATION OF LIABILITY

  1. Pensioncentral.ng is an independent product and not affiliated to the National Pension Commission (PENCOM).
  2. Pensioncentral.ng cannot keep, retain, invest or use pension money.
  3. Pensioncentral.ng is not an investment or trading platform, neither can it give visibility into how Pension Fund Administrator (PFA) and Pension Fund Custodians (PFC) manage pension funds.
  4. Pensioncentral.ng exist as a mere electronic vehicle for remittance of pension funds to respected parties
  5. You as an employer and/or user will require Pencom Code and your pension schedule to use the platform
  6. Pensioncentral.ng will only accept and process payments with valid pension schedule as provided for the employer and/or user on the platform
  7. Pensioncentral.ng shall use non-cheque payment means to facilitate remittance of pension funds, meaning you cannot go to the bank, submit a cheque and come to the platform to remit.
  8. To eliminate all hassle for pension remittance, all payments are electronic and different electronic remittance options are available to you, the employer and/or user.
  9. All data transited via Pensioncentral.ng is encrypted with electronic security certificates.
In no event shall we be liable for:
  1. Unavailability of the Platform at any time or your inability to use the Platform.
  2. Any form of delivery or failure thereof by a financial institution, merchant or telecommunication company listed on the pensioncentral.ng Platform.
  3. Erroneous input of transaction details.
  4. Any loss arising from any failure or delay in any mobile phone networks or internet service provider or defective Device.
  5. Any special, indirect, incidental, punitive, or consequential damages, including loss of profits, however caused.

We shall use our best endeavours to ensure the platform functions optimally at all times and our systems are free from viruses, however we cannot ensure such exclusion and no liability is accepted for same. Hence it is recommended you put in place your own security measures. We do not warrant that the operation of the platform will be uninterrupted nor error free, nor will it be 100% fraud or fail proof. We are providing the service "as is" without any express or implied representations or warranties with respect to the services or its condition, timeliness, merchantability, fitness for any particular purpose or use by you. We do not accept responsibility for the deletion or failure to store any user communication, actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have in this regard.

TERMINATION

In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions of Use or revoke any or all of your rights granted under the Terms and Conditions of Use. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines, or practices of Chams Access Limited in operating the Site, your sole and exclusive remedy is to discontinue using the Site.

SEVERABILITY

If any portion of these terms or conditions is held by any court or tribunal to be invalid or unenforceable, either in whole or in part, then that part shall be severed from these Terms and Conditions of Use and shall not affect the validity or enforceability of any other section listed in this document.

MISCELLANEOUS PROVISIONS

You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Assigning or sub-contracting any of your rights or obligations under these Terms and Conditions of Use to any third party is prohibited unless agreed upon in writing by both parties. We reserve the right to transfer, assign or sub-contract the benefit of the whole or part of any rights or obligations under these Terms and Conditions of Use to any third party.




PRIVACY POLICY

Chams Access Limited recognizes the importance of protecting the privacy of all information provided by a registered customer on pensioncentral.ng. This statement is meant to affirm our utmost respect for your rights to privacy.

This Privacy Policy describes the User’s privacy rights regarding pensioncentral.ng transactions. It applies to our website and all linked sites, applications and tools irrespective of medium through which you access them.

The User acknowledges that Chams Access may verify their identity information through publicly and/or restricted government databases in order to comply with regulatory requirements.

The User accepts that Chams Access shall not be liable for any loss, claim, action, expense; damage or injury suffered or sustained by the Card owner/holder whatsoever and howsoever pursuant to entering into this Agreement or as a result of the Card owner/holder’s negligence with his/her card.

You acknowledge that by your use of the Platform, we shall be privy to and store some of your personal information (full name, mobile phone number and email address).

We shall use our best endeavors to ensure that your personal information is secure on our systems.

Chams Access’ employees who handle any personal information are under an obligation to treat it confidentially and may not disclose it to un-authorized third parties.

If we need the User’s information for any other reason such as marketing, we will expressly ask or provide the User with an option to decline.

After the User has given His/her consent, He or She may for any reason change their mind; they are allowed to withdraw their consent for the use of their information.

We may use your personal information for:
  1. providing you the service, processing transactions and sending you related information;
  2. providing, maintaining and improving our services;
  3. sending support and administrative messages to you;
  4. responding to your enquiries and requests;
  5. providing customer service;
  6. updating you on products, services, promotions, rewards, and events offered by us and third parties; and
  7. A better understanding of your needs by combining it with information collected from others with the objective of improving on our service delivery.
We may disclose any information we collect about you to third parties as set forth below:
  1. to regulatory bodies;
  2. to financial institutions;
  3. to companies, such as email service providers that perform marketing services on our behalf;
  4. to third parties to enable us provide Service to you; and
  5. if required to be disclosed under applicable law, or stock exchange regulation or by a government order, decree, regulation or rule or by a court order.
